Drunk driving penalties in Pennsylvania (part 2)

As promised, we are following up with the rest of our informative post about the penalties assessed for a drunk driving arrest. Our first post from last week covered penalties for a first-time DUI. This post will cover multiple offenses. Of course, no one condones drinking and driving, but we do all mistakes. If you have been arrested for drunk driving, especially if this isn’t your first offense, it’s time for you to call Pittsburgh DUI lawyer Gary Gerson. Attorney Gerson offers a free preliminary consultation and will diligently fight on your behalf so that your penalties are minimized. If you have been arrested a second time for DUI and your BAC was .08% – .10% then you are looking at a mandatory six months of probation, at least five days of jail time (but up to six months), a year long loss of driving privileges, interlock installation for twelve months, Alcohol Highway Safety School (AHSS), and a full drug and alcohol assessment. For a second DUI offense with a BAC of .10% – .16%, it is considered a misdemeanor offense and carries with it 30 days to six months of jail time, fines of up to $5000, a twelve month license loss, AHSS, twelve month ignition interlock device, and a full drug and alcohol assessment. For a second DUI offense with a BAC above .16%, a suspect is looking at ninety days to five years in jail, AHSS, an eighteen month license loss, twelve months of ignition interlock device, a full drug and alcohol assessment, and fines that could reach as high as $10,000. If this is your third DUI and your BAC was .08% – .10%, then your jail sentence can range from ten days to two years, fines can reach $5000, there is a twelve month license suspension, a one year interlock device restriction, and a full drug and alcohol assessment. If you have been arrested a third time for drunk driving and your BAC is .10% – .16%, then you will face one year to five years in jail, $10,000 in fines, an eighteen month license loss, twelve month interlock device assessment, and a full drug and alcohol evaluation. For a third DUI with the highest BAC level of .16% and higher, a suspect is looking at one year to five years in jail, $10,000 in fines and penalties, an eighteen month license suspension, twelve months of ignition interlock, and a full drug and alcohol evaluation. For a fourth drunk driving charge in a ten years period with a BAC of .08% – .10%, you will receive two years of jail time, $5000 in fines, twelve month license loss, ignition interlock for one year, and a full drug and alcohol assessment. If you have been arrested for drunk driving a fourth time and your BAC is .10% – .16%, then you will go to jail for five years, face $10,000 in fines and penalties, eighteen month license loss, twelve months of ignition interlock, and a full drug and alcohol assessment. A fourth drunk driving arrest with a BAC at .16% or higher carries with it up to five years in jail, fines of up to $10,000, license suspension for eighteen months, ignition interlock device for twelve months, and a full drug and alcohol evaluation. If you have been arrested for DUI, it is important you call Attorney Gary Gerson to defend you in court. If this is your second, third, or fourth offense, then it is absolutely imperative that you secure Attorney Gerson as your Pittsburgh DUI defense lawyer. Attorney Gerson offers a free preliminary consultation of your case. Call 412-219-6875 for your free evaluation.
