Drug crimes and child custody

Pittsburgh Drug Crimes Attorney

People who are considered to be habitual drug abusers often have their children taken away from them after an arrest. And rightly so; using illegal narcotics can seriously affect a person’s parenting skills and decision making. It’s unfortunate, but some drug users use the benefits they get from having children to fuel their drug habit. However, there are also cases where a person who is arrested with a small amount of a low class drug like marijuana can have their children placed elsewhere by child protective services. At The Law Offices of Gary E. Gerson, we would never condone drug use, but we also understand the difference between getting busted with a small amount of marijuana and having the police walk into a home with heroin needles strewn all over the floor .

Losing child custody

I recently read the story of an arrest where police responded to reports of a baby crying inside of a van. Once they got the van doors open, police found a naked eighteen month old girl and her parents who were passed out from an apparent heroin high. Police say they found heroin needles throughout the van, as well as traces of other drugs like speed. This was not the couple’s first run in with the law or the first time they lost parental rights of child, as it was reported that their son was taken away from them a few years before. People who are high on drugs like heroin, cocaine, and crystal meth are too subdued and withdrawn to properly parent their children. If you are caught using or attempting to distribute these types of drugs and you are a provider for your child, there is chance that you can lose that child to protective custody in the process.
