Criminal defense for BB gun culprit

Reports show that an 11-year-old boy was fighting for his life at Children’s Hospital on Monday after a BB pellet was found lodged in his heart. Police say a man shot the boy with the BB gun as “payback” from an earlier incident in which the victim allegedly shot the man’s 5-year-old son. The 31-year-old McKeesport man is being charged with shooting the 11-year-old boy with a BB gun on the basketball court of the George Washington Elementary School in McKeesport Sunday evening. The man told investigators that he was angry with the boy because the boy shot his 5-year-old with a BB gun on Saturday at the same playground. That’s when, police say, the man took action into his own hands and confronted the boy the following day. Witnesses say the first shot missed, but that he aimed and fired a second time from point blank range and struck the boy in the chest. The boy collapsed immediately and complained of not being able to breathe. The man then ditched the gun with another boy who witnesses say was passing by. Police say they found more than 5000 BB rounds at the suspect’s home. He has been arrested and charged with aggravated assault, criminal attempt, reckless endangerment charges, and tampering with evidence. He is in the Allegheny County Jail on $250,000 bail. Witnesses said they saw him put the barrel of the BB gun to the boy’s chest and shoot him at point-blank range. Then, witnesses say, the boy lost his breath and began turning blue.
