In fact, according to the United States Department of Justice, any picture that may be teetering the line will be treated as child pornography. And consent age does not apply whatsoever. That means that if you have pictures or video of a minor doing suggestive things, then it is considered illegal, no questions asked.

Man arrested for making and sharing child pornography

Recently, a Pennsylvania man was arrested on several counts of child pornography. He was also charged with three counts of privacy invasion and a count of what police call “criminal use of a communication facility.” After searching the man’s home and computer, they were able to a number of files that contained pornographic pictures and videos of children between the ages of six and seven, as well as home video taken of two underage girls through a window in their home. The man was able to be caught through high activity in a media-sharing network. And through the man’s IP address, investigators were able to track him at his home.
